Terms of Service
These Terms of Service govern your use of the NexaMart website and any purchase you make from it. Please read them carefully — they set out the agreement between you and NexaMart ("we", "us", "our").
1. Acceptance of these terms
By browsing this website, creating an account or placing an order, you confirm that you accept these terms and that you are at least 18 years old, or that you have the consent of a parent or guardian. If you do not agree with any part of these terms, please do not use the store.
We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order.
2. Products and descriptions
We describe our products as accurately as we can, including specifications, materials and dimensions. Photographs are for illustration; colours can vary slightly between screens, and packaging may be updated by the manufacturer without notice. Where an accessory is not explicitly listed as included, please assume it is not.
Product availability is not guaranteed. We may withdraw or change a product at any time before your order is accepted.
3. Orders
Placing an order is an offer to buy. Your order is accepted when we send the dispatch confirmation email, and it is at that point that a contract is formed between us. We may decline or cancel an order if:
- the item is out of stock or has been discontinued;
- a price or description error has occurred;
- payment is declined or flagged as fraudulent;
- we cannot deliver to the address you provided.
If we cancel an accepted order, we refund you in full.
4. Pricing and payment
All prices are shown in the currency selected at checkout and include applicable sales tax where required by law. Shipping costs are calculated and shown before you pay. Prices may change at any time, but changes will not affect orders we have already accepted.
Payment is taken at checkout through Shopify Payments or another approved provider. You confirm that you are authorised to use the payment method you provide. In the rare event of an obvious pricing error, we will contact you before dispatch and offer the correct price or a full refund.
5. Delivery, returns and refunds
Delivery timescales, costs and carrier arrangements are set out in our Shipping Policy. Your right to return an item, the 30-day window and the refund process are set out in our Refund Policy. Both policies form part of these terms.
6. Accounts
If you create an account, you are responsible for keeping your login details confidential and for all activity that takes place under your account. Tell us immediately if you believe your account has been used without your permission. We may suspend or close an account that is used for fraud, abuse or any breach of these terms.
7. Intellectual property
The NexaMart name, logo, site design, text, graphics, product photography and code are owned by us or licensed to us and are protected by intellectual property law. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, resell, scrape or use our content or branding for commercial purposes without our written permission.
Third-party trademarks referenced on this site remain the property of their respective owners.
8. Acceptable use
You agree not to use this website to transmit malicious code, attempt to gain unauthorised access to our systems, place fraudulent orders, harvest data by automated means, or interfere with the site's operation or security.
9. Reviews and submissions
If you send us a review, photograph, comment or suggestion, you grant us a non-exclusive, royalty-free licence to use, reproduce and publish it in connection with our store. You confirm that the content is your own and does not infringe anyone else's rights. We may edit or remove submissions that are unlawful, misleading or offensive.
10. Product use and safety
Follow the instructions and safety warnings supplied with each product. Wellness, support and personal-care products sold on this store are consumer goods, not medical devices, and nothing on this website is medical advice. If you have a health condition, consult a qualified professional before use.
11. Limitation of liability
We provide this website and our products with reasonable care and skill. To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, including loss of profit, data or opportunity, arising from your use of the site or a product. Our total liability in connection with any order is limited to the amount you paid for that order.
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded — including your statutory consumer rights, which are unaffected.
12. Third-party links and services
Our store may link to third-party websites or use third-party services such as payment, analytics and shipping providers. We are not responsible for the content, policies or practices of those third parties, and your use of their services is governed by their own terms.
13. Force majeure
We are not liable for delay or failure to perform caused by events outside our reasonable control, including natural disasters, strikes, carrier failure, war, epidemics, government action or failures of telecommunications or utility networks.
14. Severability and entire agreement
If any provision of these terms is found to be unlawful or unenforceable, that provision is severed and the remaining terms continue in full force. These terms, together with our Privacy, Shipping and Refund policies, form the entire agreement between you and NexaMart.
15. Governing law
These terms are governed by the laws applicable at the place of NexaMart's principal place of business, and any dispute will be handled by the competent courts of that jurisdiction, without affecting any mandatory consumer protections available to you where you live.
